  • This agreement is made, and hereby entered into, on this day_____________________ between Carrie Burr, (Seller), and___________________________________, (Buyer), for the purpose of setting forth the terms and conditions of the purchase by the Buyer of a purebred English Shepherd from the litter whelped on November 13,

    Sire: Liquid Moon Sutton ESC # 8893; UKCD209-400

    and

    Dam: Copper Valley’s Sunny Blue ESC 8682

    1. The Seller agrees to sell and the Buyer agrees to buy one puppy (hereafter referred to as Puppy) from the above described litter. The puppy covered under this contract has a litter call name of _______________and is a male _____/female_____. The Buyer agrees to put a deposit of $300 of the $1,225.00 purchase price down to reserve the puppy. The deposit is due at the time this contract is signed.

    2. The Seller warrants that Puppy will be in good health and free of communicable diseases at the time Buyer assumes ownership. Seller will have puppy examined by a veterinarian and receive first set of vaccinations before 8 weeks of age. Buyer agrees to have Puppy examined by a licensed Veterinarian. Within three weeks

    weeks of taking possession of said Puppy, the Veterinarian determines that Puppy is not in good health, then the Buyer shall elect to either keep Puppy and assume full responsibility for all medical treatment or return Puppy to

    the Seller for a full refund. If the Buyer elects to return Puppy, the Buyer will provide the Seller with a written Veterinarian's certificate stating that the puppy was in poor health when examined. Upon receipt of Puppy, the Seller shall be obligated to refund all monies received from the Buyer toward the purchase of Puppy, and further

    performance under this contract shall be null and void. All action taken to return Puppy shall be with Puppy’s best interest in mind. Seller assumes no responsibility for medical expenses

    3. The Buyer agrees that any and all transportation costs, to and/or from the Seller's premises, will be at the cost

    and sole responsibility of the Buyer.

    4. The Buyer agrees to maintain preventative health care of the puppy including, but not limited to: inoculations, internal and external parasites, and heartworm preventative medication. The Buyer agrees to maintain preventative care of the puppy in regards to hip dysplasia, such as proper nutrition, proper exercise, fit weight, and preventing stress injuries.

    5. The Buyer agrees that Puppy will not be used for breeding purposes until he/she has been evaluated for the then recommended health and genetic screening for ESs. This would include the presence of risk for Hip Dysplasia, through OFA or Penn HIP screening, and PRA-6, etc. and then bred only to another registered English Shepherd. If any tests come back positive for issues, Puppy should not be used for breeding purposes and should be spayed or neutered.

    6. The Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of Puppy and that the Buyer will not sell Puppy or any of his or her progeny to any agent, broker, or pet store.

    7. The Buyer agrees that should it become necessary to re-home Puppy for any reason, the Buyer will notify the Seller before taking such action. The Seller will take Puppy back at this time with no refund of purchase price if that is the Buyer's wish. If the Buyer chooses to breed the ES this will also apply to the new puppies.

    8. The Buyer agrees that the Seller may repossess Puppy upon evidence of neglect and/or abuse at no expense to the Seller, and no refund of any monies.

    9. The Buyer agrees that Puppy will reside at the home of the Buyer. Puppy is sold with the understanding that he or she is to go to selected homes, be socialized properly, be provided with comfortable and humane living conditions, and become a valued member of the family.

    10. The Buyer agrees to notify the Seller of the time and circumstances of Puppy's death.

    11. The Buyer agrees to keep the Seller updated on Puppy’s progress by means of pictures, emails, or calls. This will help the Seller to continue to evaluate the litter as the puppy gets older.

    12. The Buyer agrees to notify the Seller of any health conditions Puppy develops over his/her life. Knowing the health of this line’s offspring will help the Seller make future decisions on breeding stock.

    13. The puppy is currently registered with the English Shepherd Club Registry. If the Buyer decides at a later date to also UKC register the pup, the Seller will aid in this process.

    This Agreement is made and signed by both parties to ensure the wellbeing and protection of Puppy. If any part of this Agreement is breached by the Buyer, the Seller is released from any further obligations hereunder.

    If the Buyer violates this agreement, the Buyer will be responsible for any/all legal costs the Seller acquires enforcing this contract. This contract is deemed and entered into in the State of New York & is subject to

    the New York State Law. This agreement constitutes the entire understanding between the parties.
